Terms & Conditions
By paying for and downloading any work published by Almaré Creative (Renata Cação), you agree to the following Terms and Conditions. If you have any questions or concerns regarding these T&Cs, please contact Renata Cação for clarification before downloading your photos or videos.
Real Estate Photography License Agreement
Almaré Creative (Renata Cação) owns the copyright to all digital images created (music and any additional third party content remain the property of the creator).
The real estate agent/owner (referred to as "Client") who orders the photo is granted a license to use the images of the property for which they paid to promote that specific property in any media. If the photos are to be used in printed materials (e.g. magazines, billboards, etc.) to promote the property or the company in general, please inform the Photographer.
Minor changes to the images or videos are permitted, such as minor cropping and/or resizing.
The Client is not authorized to sell or give away the images to third parties, other real estate agents, builders, architects, stagers or any other suppliers. The Photographer acknowledges that the Client has no control over the sharing of images between real estate portals (Idealista, Rightmove, Imovirtual, etc.) and is not responsible for any failure on their part to comply with the terms. If, after selling the property, the now ex-owner wishes to keep a copy of the photos for emotional attachment, this request must be made to the Photographer, who will provide them in a lower quality format and with a watermark within 12-24 hours, on the condition that they are not shared beyond the ex-owner.
Finished images are stored securely by Almaré Creative (Renata Cação) and can be redelivered upon request within 90 days of the original delivery date. Please note that beyond this period, the availability of photographs cannot be guaranteed. A longer storage period will be available at an additional cost, please contact me for more information. To ensure uninterrupted access to the images for the duration of the listing, it is strongly advised that the Client creates a local backup copy of the files.
Renata Cação reserves the right to use any photograph or video for advertising, social media, website and printed materials, unless otherwise mutually agreed in advance. During the period in which the listing is online, social media posts on the Almaré Creative page will link to the listing on the Client's website and respective social networks, thus enabling the listing to reach an even larger and different audience.
Real Estate Photo Shoot Preparation Guidelines
Please ensure that all occupants are off the premises during the pick-up period. If occupants are unable to be off-site due to illness or other constraints, please inform me in advance. Every effort will be made to complete the image capture in a safe/quick manner to avoid any unnecessary inconvenience.
Below is a complete and up-to-date set of Real Estate Photo Shoot Preparation Guidelines. These should be completed 10 minutes before the photo shoot scheduled by the seller or agent. The seller or agent should allow a minimum of 1 hour for the photo shoot to be completed, and will receive a text message when the photo shoot is finished.
BEFORE THE SESSION
All interior and exterior lights on - even during the day; replace broken/missing bulbs. All ceiling fans turned off;
All blinds/shutters/curtains open or pulled up;
Toilet seat covers down;
Toiletries not visible;
Garbage/recycling bins not visible;
No cars in the driveway or parked directly in front of the house;
Children, pets out of sight, pet objects and toys put away;
Photos of people placed out of sight, if not possible, photos in frames will be blurred in post;
The doors of all rooms to be photographed must be open and the rooms ready;
I ask the occupants to leave the premises before my arrival. I ask that we are provided with a key or a lock code 24 hours before the appointment, or the agent may have to open the property on my arrival. Unless otherwise stated, I must have a minimum of 1 hour to complete the photo shoot.
Lifestyle details can enhance your exterior images!
Barbecues cleaned and covers removed;
Flowers in pots;
Add color to outdoor furniture with cushions or blankets;
Swimming pool uncovered and cleaned;
Set the table and decorate it with glasses, bottles of wine, jars of tea and flowers;
In the case of drone use, the National Aeronautical Authority (Autoridade Aeronáutica Nacional) now requires requests at least 10 days in advance to fly. Without this approved request, I will not be able to launch the drone, as I will be restricting Portuguese privacy laws;
While using the drone, I ask that anyone present on the property move inside and avoid windows or glass doors so that they are not caught on camera and run the risk of exponentially increasing the time it takes to edit and consequently deliver the material.
PREPARATION POLICY
The Client is responsible for having an authorized representative present at the photo shoot to approve the Photographer's interpretation of the project. If a representative of the Client or the real estate company is not present, the Photographer's interpretation will be considered final.
The Photographer will make a small effort to remove displaced objects etc. from rooms; however, please note that this does not include things like making beds or dragging furniture. Agents are expected to have the preparation and cleaning of the property completed before the photo shoot begins.
All properties will be photographed "as is". If you have a specific preference, your presence and opinion is important in choosing the best rooms and angles to photograph. In the absence of your opinion, the Photographer will use her best judgment and experience to decide the best way to photograph the property, and the resulting images will be considered final. This includes determining subtle details such as lights on or off, blinds open or closed, etc.
Postponements / Cancellations
In the event of a postponement due to lack of preparation of the property when the Photographer arrives, a fee of €50 will be charged to compensate for time and travel costs and we will reschedule for another time.
In the event of a postponement on the day of the shoot by the Photographer or the Client due to weather conditions, no fee will be charged and we will reschedule immediately. Please note that if the day is gray (even if it's not raining) the results will never be as good as if the day is fine, however this decision will be made solely by the Client.
In the event of a postponement for unforeseen reasons by the Client within the 24 hours prior to the session, no fee will be charged as long as we reschedule immediately.
Payment
Payment of the full amount must be made by the date the photo shoot is booked, otherwise it will be canceled if it is not made. Accepted and preferred payment methods are: MBWay, Paypal or cash. Bank transfer, with proof and at least 2 working days before the appointment, is also accepted.
Delivery time
Photos will be delivered within 12 to 24 hours, unless otherwise stated.
Please do not hesitate to contact me with any questions.
